CARE IN THE GARDEN'S MAKE A DIFFERENCE CARD TERMS & CONDITIONS

The promoter of the loyalty scheme is Care In The Garden, The Plant Market, Park Road, Wootton, PO33 4NS.

Care In The Garden’s Loyalty Scheme rewards members with a 5% discount on future purchases made in person at The Plant Market, Park Road, Wootton, PO33 4NS. By joining the Loyalty Scheme and using a Make a Difference card, you automatically accept these Terms & Conditions. These Terms & Conditions explain your and our rights and obligations. Please read them carefully. You may have other rights granted by law, and these Terms & Conditions do not affect these except where the two are inconsistent. If that is the case, these Terms & Conditions will override any other rights, unless not permitted by law.

JOINING THE LOYALTY SCHEME

  • When applying for a Loyalty Card, you must provide your first name, surname, postcode, and a valid email address to register the card. Cards are for personal use by the registered cardholder only and are non-transferable.

  • Only one membership per household is permitted. Care In The Garden reserves the right to refuse, merge, or close additional accounts at any time.

  • By applying for a Loyalty Card, you accept that we may send up to 12 marketing emails per year to the email address you provide.

  • A charge of £2 (including VAT) will apply to cover the cost of the card.

  • This scheme is open to UK residents only. All members must have a valid UK address and be aged 18 or over.

  • All cards remain the property of Care In The Garden and must be returned or destroyed if no longer valid or requested by us.

  • We may terminate, alter, or amend the conditions or operation of the Loyalty Scheme at any time. You should check the latest Terms & Conditions at www.careinthegarden.com regularly.

  • Discounts can only be claimed once your card has been registered. You will receive an activation email within 5 working days confirming that your card is ready to use.

  • We reserve the right to refuse or cancel your membership without prior notice if you breach these Terms & Conditions or misuse the Loyalty Scheme.

  • You may cancel your membership at any time by emailing careinthegarden@hotmail.co.uk. Please include your request to cancel and delete your data.

  • You are responsible for the security of your card. Please notify us immediately if your card is lost, stolen, or misused. We are not responsible for unauthorised use.

  • You must not share your card number or membership details with any third party.

  • It is your responsibility to keep your personal details up to date by emailing careinthegarden@hotmail.co.uk with your card number and changes.

  • If your card is lost or stolen, you may request a replacement card by contacting us. A small replacement fee may apply.

  • If your card is not used for a continuous period of 12 months, we reserve the right to deactivate your membership.

USING YOUR CARD

To obtain the discount, your Loyalty Card must be presented in person at the time of purchase. Discounts cannot be applied retrospectively.

You cannot claim a discount on purchases made before joining the Loyalty Scheme.

Loyalty discounts are not available on purchases made via www.careinthegarden.com.

Additional discounts, offers, or events may be made available to Loyalty Scheme members from time to time.

The discount applies to most merchandise sold by Care In The Garden at The Plant Market, Park Road, Wootton, PO33 4NS, except gift vouchers and other excluded products (as notified at the main till in store).

OUR LIABILITY

  • Nothing in these Terms & Conditions limits any legal rights you may have or excludes liability for death or personal injury caused by our negligence or that of our employees or agents, or for fraud or fraudulent misrepresentation.

  • We accept no liability under or in connection with these Terms for: - Losses that are not foreseeable (a loss is foreseeable if it was an obvious consequence of our breach or was contemplated by both parties at the time these Terms were agreed) - Losses not caused by any breach on our part - Business losses, including loss of profits, contracts, goodwill, or business opportunities

  • These limitations do not affect any liability that cannot be limited or excluded by law.

YOUR INFORMATION

  • Care In The Garden collects and uses your information to: - Administer your Loyalty Scheme membership - Communicate with you about your membership - Understand your preferences to improve our services - Provide information on products, services, and promotions - Monitor and improve our business, including market research - Detect and investigate fraud or misuse

  • We do not share your data with third parties for direct marketing.

  • You can unsubscribe from marketing at any time by emailing careinthegarden@hotmail.co.uk with your name and card number.

  • We will retain your personal information for up to 12 months after your membership ends unless otherwise required by law.

LEGAL

  • These Terms & Conditions replace all previous versions and are correct as of 1st May 2025.

  • They are governed by English law, and any disputes will be resolved in the English courts exclusively.

  • A person who is not a party to these Terms & Conditions will not have rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms, but this does not affect any right or remedy available apart from that Act.

  • Due to printing lead times, in-store versions of these Terms & Conditions may not reflect the most recent changes. The online version at www.careinthegarden.com is always the most up to date.
